The owner of this site also, however, deplores antiwar.com's accusation that  ISP administrators are personally guilty because of something that one of their subscribers may have done. A photo of someone wearing a funny T-shirt is not evidence of a crime, and that photo has been removed from this site.

The accusation you read against Samir Mekic is not true.

Holding the system administrator of an Internet Service Provider liable for the activities of a subscriber is a dangerous attack on Internet free expression!

It will cause fewer people to be willing to take the risk of hosting controversial sites if they can be found guilty of anything that any subscriber does.

We oppose this type of chilling effect on Internet free expression!

You should  only think about starting to hold an ISP accountable for such actions if 1) the ISP has been contacted by the victim site and asked for help,  2) the ISP refuses to take even basic measures to help track down the source of an attack or shut down an attack in progress, and 3) you are sure that the attack didn't come from a spoofed address or via a Trojan horse or other hacker tool that seizes control over a system without the administrator's knowledge.

But certainly you can't jump to the conclusion that the administrator is CONDUCTING the attack because the attack appears to be coming from that ISP address, which has hundreds or thousands of subscribers.
